Terms of use

1. In this document and in any relationships between the Parties arising from or related to it, the following terms and definitions apply:

Platform — hardware and software integrated with the Administration’s Website;
User — a legally competent natural person who has entered into this Agreement in their own interest or acting on behalf of and in the interests of the legal entity they represent.
Administration Website / Site — websites located at the domain https://thailand-real.estate and its subdomains.
Service — a set of services and a license provided to the User through the use of the Platform.
Agreement — this agreement, including all amendments and modifications.
Agencies — authorized entities that post real estate advertisements on the Website.
Buyer — a potential buyer/tenant of a property listed on the Website as an advertisement.
Content - all items posted on the Site, including design elements, text, graphic images, illustrations, videos, scripts, programs, sounds, and other items and their compilations.

2. Your Responsibilities

You must be at least 18 years old to contact Agencies through our Website and guarantee that the information you provide is accurate.
Real estate listings on our Site are submitted by third-party Agencies, which are responsible for the accuracy of the information regarding the properties they publish and for forwarding inquiries. Prospective Buyers are responsible for verifying the accuracy of the property descriptions displayed, and Agencies are responsible for ensuring the accuracy and completeness of the property descriptions presented on our website. We post property information in good faith on behalf of Agencies and do not verify it. The property listing pages on our website do not contain property details, and these must be obtained directly from the Agency selling the property.

3. Disclaimer and Liability

The Site and its content are provided on an “as is” basis. We do not provide you with any advice (investment, financial, or otherwise) regarding any content on our Site. Furthermore, we make no warranties:

regarding the suitability for any purpose, compatibility, reliability, accuracy, completeness, accessibility, or usability, or the quality of the Content posted on our Site;
the uninterrupted operation of the Site, without interruptions or failures.

Any property valuations found on our website are intended solely for general informational purposes and should not be used for any commercial transactions or similar purposes. These valuations are based on publicly available information, as well as information provided by Agencies, which may be inaccurate or incomplete.
We are not liable:

for any interruption or loss of service;
for any losses incurred as a result of using our property valuations;
to users for any losses or damages arising from the use or inability to use our Site or its Content.
for lost profits, sales, business interruption, goodwill, or reputation, as well as any indirect losses or damages.
for the content of websites linked to on our Site, and these links should not be interpreted as an endorsement by us of these linked websites.

We may need to make the Site unavailable for technical work on it, with or without notice.

4. Disclaimer

You agree to indemnify, defend, and hold harmless us and our affiliates, shareholders, officers, directors, employees, agents, or suppliers from any claims or demands made by any third party arising out of or in connection with your use of our Site.

5. Viruses

We do not control and do not guarantee the absence of viruses or other elements that may cause disruptions to your computer system (software and hardware) or to electronic documents and files stored on your computer. We do not guarantee that the Site will be completely secure or free of errors or viruses. It is your responsibility to protect your computer from viruses. not to use the Site in any unlawful, immoral, or harmful manner (including to commit or facilitate any fraud against us);
not to use the Site in violation of any policies or other notices on the Site;
avoid posting materials that may contribute to a violation of any applicable laws or regulations;
not transmit copyrighted materials without the owner’s permission;
maintain standards of decency in your conduct while using the Site.

9. Governing Law

These Terms of Use are governed by the laws of Thailand, and the agreement between you and us is made in Thailand. Any disputes will be resolved in the courts of Thailand, although we may take action to protect our intellectual property rights in any relevant jurisdiction.

10. Other Provisions

The headings in these Terms of Use are for convenience only. Our delay or failure to enforce or enforce any right or provision of these Terms of Use shall not constitute or be construed as a waiver of such right. We shall not be liable for any breach of these Terms of Use caused by circumstances beyond our control.
